Terms and Conditions

The following are the terms and conditions applicable to the rental of the property known as “Craggy Nook”, Hastings, Christ Church, Barbados. No amendments to or deletions from these terms shall be valid unless expressly accepted and confirmed in writing.

THE PARTIES

  1. Hereinafter, the “Client” refers to the person signing the Rental Agreement. His/Her signature
    shall constitute acceptance of the following booking conditions on behalf of the client and every
    guest on whose behalf he has the authority to sign.
  2. The “Company” refers to Caribbean Island Properties.
  3. The “Owner” refers to the Villa Owner and/or the Property Management Agency managing the

THE AGENT
The Company acts as an Agent for the Owner in making arrangements for the rental of the villa.

THE AGREEMENT
The Rental Agreement shall not become binding until the Company has received the rental deposit from the Client together with written confirmation of booking dates.

EXCEPTIONS
If for any reason, other than the acts of neglect or default on the part of the Owner, the Client refuses or is unable to use the property in accordance with the terms of Agreement, the full rental fee shall be retained by the Owner.

MINIMUM AGE OF PRIMARY RENTER
Be aware that the minimum age for the primary renter on this villas is 30 years old.

DEPOSITS AND PAYMENTS
Payment by the Client to the Company of a deposit equal to 50% of the total rental fee is required for confirmation of the booking. The remaining 50% is required no later than 60 days prior to the date of the Client’s arrival at the Villa. In the event that the Agreement becomes binding inside the window of the 60 days, the Client is required to pay the total rental fee to the Company to secure the booking. If full payment is not received 60 days prior to the Client’s arrival at the Villa the Owner reserves the right to cancel the booking, thus causing the Client to forfeit the paid deposit. Payment may be made by wire transfer to the account provided or via credit card.

CANCELLATION POLICY
Outside 90 days prior to the Client’s arrival date at the villa the Company will refund the total deposit to the Client if and when the Company receives written notice of the cancellation. 90 days prior to the Client’s arrival date at the Villa the Company will refund 50% of the total deposit to the Client if and when the Company receives written notice of the cancellation. Up to 60 days prior to the Client’s arrival date at the Villa the Company will refund 25% of the total deposit to the Client if and when the Company receives written notice of the cancellation. Where cancellation is made within 60 days of the arrival date at the Villa no refund is due.

CHECK-IN TIMES
A check-in time of 3:00 pm applies. Where circumstances permit, allowances may be made for early check-in except for ‘changeover’ days where an arrival and a departure occur on the same day in the same unit. If you are arriving on a changeover day we will not be able to accommodate an early check-in.

DEPARTURE TIMES
A departure time of 11:00 am applies. On a changeover day, where a departure and arrival for the same unit occur on the same day, this departure time will be strictly applied in order to prepare the unit for the subsequent arrival. Any request for late departure must be cleared with your property manager prior to your arrival. On changeover days, at the property manager’s discretion, a grace period of one hour may be allotted which would permit the use of a specified bedroom and bathroom (except the Master bedroom & bathroom) until 12:00 noon in preparation for departure. This grace period must be discussed and agreed on by the property manager in advance. After this, one hour grace period has expired the property must be vacated to allow for preparation for the incoming guests.

TIDINESS AND DAMAGE
The Client shall respect and ensure that the Villa and all furniture, fixtures and effects are in good order and condition (fair wear and tear expected) and shall promptly inform the Company of any damage caused to the property or its contents during the period of occupation by the Client. The Client shall incur all charges for such damage and for any missing items. The Client shall respect that there is to be no smoking inside the Villa. Smoking is permitted in the outdoor common areas or along the beach directly in front.

DISPUTES
In the event that any dispute and/or difference should arise between the Client and the Owner (that which cannot be resolved speedily and amicably), the matter(s) in question shall be resolved by arbitration in Barbados in accordance with Barbadian Law.

MAXIMUM OCCUPANCY
At all times the maximum occupancy is the number the apartment sleeps (this is two persons per double bed and one person per single bed). Craggy Nook occupancy is six persons for three bedroom units and four persons for two-bedroom units, children included. Exceptions may be made for infants below two years who will sleep in a cot. Guests and visitors must be pre-approved by the Agent before arrival to the property. If you bring extra guests without prior disclosure, approval and payment there will be a charge incurred and extra guests may be asked to vacate the property at the Property Manager’s discretion.

ACTS OF GOD
Neither the Owner nor the Company will be liable for any events beyond their control which may interfere with the Client(s) occupancy, including but not limited to natural disasters, civil unrest, strikes, inclement weather or any other occurrence which could not have been prevented by any amount of foresight, planning and care.

USE OF VILLA
The Client may not use the Villa for any purpose other than that of a private holiday residence for the accommodation of the Client and his guests unless otherwise agreed upon in writing by the Owner. The Client shall not engage in any activity or practice that may be or become a nuisance or annoyance to the Owner, the other tenants of the Villa or occupants of adjoining land or that might invalidate any insurance policies effected on the Villa, and shall not bring any animals or pets to the Villa. The Client must notify the Company of how many individuals will be staying at the specified Villa during the rental period and the ages of any children. The client shall not sub-let or assign his rental of the villa. Unless previously agreed with the Company and/or the Owner, the Client will vacate the villa by 11:00 am on the final day of the rental period.

SECURITY DEPOSITS
A Security Deposit of US$1,000 (one thousand United States Dollars) is required when making the initial deposit or final payment if dates are within the 60 days of travel. Any Security Deposit shall be held by the Owner as collateral for any loss or damage to the property or its contents during the time of occupancy of the Client. At the end of the rental period the Owner reserves the right to deduct the subsequent amounts from the security deposit should there be any damages, lost items, overseas telephone calls or any other miscellaneous expenses. Provided no damages or charges are incurred a Full Refund of the Security Deposit shall be made within 30 days following the Client’s departure from the Villa.
